nadie se saltaba y algo que unía a todos y era Bueno pues lograr consolidar nuestro estado democrático y la defensa de nuestro sistema nuestro estado de derecho así que por eso estoy aquí porque creo en la defensa ultranza de la independencia judicial creo que sin Independencia judicial sin separación de poderes y sin respeto a imperio de la ley no existe democracia efectivamente soy una presidenta del la apm que es la asociación mayoritaria y que entre sus fines está defender difundir y promover los valores constitucionales esencialmente esto el Imperio de la ley el respeto a la Constitución y eso lo que hace que seamos una democracia y no seamos una serva o un régimen de aquellos que les gustan algunos pero que está del otro lado del Atlántico aquí yo de momento en mi país No lo quiero y nos estamos cargando absolutamente todo Nosotros hemos ido muchas veces a Europa ya diciendo lo que está pasando en este país porque estamos viendo como hay un deterioro permanente de las instituciones con un auténtico desgaste de nuestro estado de derecho Como cada día se está deslegitimando la función judicial se está desprestigiando a los jueces y todo esto tiene un fin es conseguir finalmente esto la impunidad Pero uno no se levanta un día de la cama y dice anda estoy en Polonia No aquí Hemos llegado un camino largo y tortuoso un camino en el que a veces hemos estado muy solos los jueces también hay que decirlo no yo recuerdo que en el año 2017 cuando se produjo eh la declaración de independencia de Cataluña se alegaba por los partidos independentistas que el los jueces estaban en contra de la voluntad del pueblo porque en su entendimiento de la Democracia la mayoría parlamentaria está por encima de la constitución y por encima de la ley lo que yo quiero es la ley y eso es lo que hay que hacer y los jueces éramos enemigos del pueblo Hubo un tiempo en el que hubo un consenso no todos los partidos los partidos principales del Arco parlamentario creían que debían ser condenados esos hechos la sedición la malversación y cuando se dicta la sentencia por la sala segunda en el pluses ahí se acoge digamos favorablemente lógicamente no por el independentismo Catalán lógicamente te han condenado como te va a gustar hombre tampoco son tontos son independentistas nada más pero resulta que pasan los meses y llegamos a enero del año 2020 y ya en la sesión de investidura Pedro Sánchez habla de un exceso punitivo y lo dice al referirse a la sentencia de la sala Segunda del tribunal supremo no empezamos bien efectivamente tenía razón Marchena no estamos empezando bien Luego llegó la pandemia eso daría para muchas más mesas redondas y en ese caso también los jueces fuimos permanentemente acusados de querer que los ciudadanos se murieran porque se nos ocur defender el estado de derecho defender los derechos y las libertades de los ciudadanos y entendíamos que determinadas resoluciones no solamente del ejecutivo nacional también determinadas comunidades autónomas podían estar vulnerando los derechos y libertades de los ciudadanos llegó el tribunal constitucional otro tribunal constitucional en ese batiburrillo de que poder judicial y tribunal constitucional para el ciudadano somos lo mismo y el tribunal constitucional quería que los ciudadanos se muriesen los jueces querían que los ciudadanos se muriesen por tanto los jueces seguimos siendo malos Luego llegó la ley del s sí nos faltaba ya los jueces machistas porque por más que se advirtió en informes que se emitieron por el consejo fiscal por el consejo general del poder judicial y por los jueces cuando nos preguntamos preguntaban decíamos que esa ley iba a tener unos efectos nefastos por qué porque iba a suponer la revisión de las condenas y en la mayoría de los casos la rebaja de las penas y por eso hemos visto a agresores sexuales y a violadores pasearse por la calle Cuando esto sucedió los jueces machistas fascistas con toga franquistas con toga éramos lo de siempre yo recuerdo que Pedro Sánchez dijo que eso la sala segunda lo iba a arreglar ahí tuvo que reconocer la ayuda inestimable de la fiscalía general del estado que dictó una circular para decir que los jueces estábamos interpretando mal una disposición transitoria que por cierto no existía pero luego llegó la sala Segunda del tribunal supremo y parece que no estaban tan equivocados el resto de los jueces de la trinchera en la revisión de las penas ya era lo que nos faltaba seguíamos siendo lógicamente machistas pero la aritmética parlamentaria que es la que manda las matemáticas son así al final yo me fui a letras por eso porque nunca trae nada bueno nos llevan a un acuerdo de investi dura el 9 de noviembre del año 2023 el día de la almudena yo me había cogido el día bueno era fiesta en Madrid y de repente nos encontramos con este acuerdo que se fundamenta entre otras cuestiones de carácter político que a mí francamente no son de mi negociado y yo también entiendo que cuando tú quieres gobernar Pues tienes que ceder cuando no tienes la mayoría si sin embargo se habla efectivamente del ler y de la creación de comisiones de investigación comisiones parlamentarias para revisar qué han hecho los jueces esa es eler esa judicialización de la política para adoptar en su caso las medidas necesarias Seguimos avando avanzando porque ya el 16 de noviembre se presenta la proposición de ley de amnistía la impunidad total y absoluta porque no habíamos tenido bastante con despenalizar la sedición con cambiar eh el delito de malversación con indultar era poco teníamos que hacer una amnistía para perdonar todo aquí no ha pasado nada borrón y cuenta nueva una forma de inmiscuirse total rotunda y absolutamente en la labor judicial a sabiendas de que es una ley inconstitucional y me imagino que la sentencia del tribunal constitucional diga lo contrario lo Admito lo asumo es una ley inconstitucional eh supone eso permitir que los ciudadanos no seamos iguales ante la ley permite esto la impunidad y llegados a este punto y cuando parecía que ya nada podía ir a peor Pues a un juzgado el juzgado de instrucción número 41 se le ocurre incobar un procedimiento nada menos investigando a la mujer de Pedro Sánchez AB begoña Gómez por la presunta comisión de delitos digamos relacionados con la corrupción política para meterlo todo en el mismo saco y acabar antes a partir de ahí el chorreo de críticas ya lo han escuchado ustedes nosotros también nos hemos dirigido al parlamento europeo y a la comisión Europea el juez está haciendo una instrucción cruel e inhumana es todo la derecha judicial el brazo judicial del PP le han buscado fotos de su familia han ido hasta su pueblo para ver si tiene la casa apagada si está su nombre pero vamos a hasta tenía dos dne fíjese usted hasta dos dne tenía Juan Carlos peinado los ataques han sido una auténtica barbaridad han llegado al ataque personal pero ha creado sobre todo el caldo de cultivo para lo que se pretende que es la impunidad uno no se levanta ni piensa que va a tener suerte y que no le van a condenar si no sabe que eso efectivamente puede pasar y se ha creado esa idea en la sociedad de que los jueces Somos unos seres oscuros si ustedes leen la la el anteproyecto la proposición de ley Perdón desde el principio es que ya somos malos porque lees acciones judiciales abusivas lo que yo pensaría es que somos los jueces los que Abusamos en el ejercicio de las acciones si no no somos los jueces se supone que es la acusación popular Pero somos eh oscuros Además nos dedicamos a maltratar a colectivos vulnerables porque esto es para proteger a esos colectivos vulnerables somos tan tontos que además cualquier noticia de prensa incamos ya un procedimiento aunque no tenga mayor sustento y además Nos tienen que poner una mordaza porque para eso hay que reformar el artículo 219 de la Ley Orgánica del poder judicial incluyendo un una nueva causa de abstención y de recusación Mire voy a empezar por esto último porque esto enlaza con un anteproyecto que se aprobó en el consejo de ministros el día 21 de enero y que avanza más en ese paso permanente de atacar a los jueces y de atacar uno de los pocos mecanismos que tenemos los jueces de expresarnos que es a través de las asociaciones judiciales se habla incluso de entrar el congreso de los diputados y el senado en la configuración y la Constitución de los miembros de la comisión de ética judicial un órgano que únicamente que es autónomo del Consejo general del poder judicial y que únicamente elegimos los jueces y cuando llevamos décadas pidiendo que la elección de los vocales judiciales se haga únicamente por el congreso y el senado para evitar cualquier eh duda de la politización del órgano y que nadie pueda sospechar ahora queremos entrar en la comisión de ética judicial un anmel la comisión de ética judicial con la modificación de las causas de abstención y de recusación y retrotech 2023 cuando a finales de cuando ya conocemos la la el acuerdo de investidura cuando se habla del lufer de las comisiones de investigación y las diferentes salas de gobierno de los tribunales Superiores de justicia de este país emiten un comunicado contrario al lowfer y contrario a las comisiones de investigación y cuando se hacen concentraciones convocadas por los jueces decanos en casi todos los partidos judiciales donde los jueces se manifiestan en la puerta pues mire como es est molestaba lógicamente porque lo que se trata es de evitar que nadie cuestione lo que yo hago porque eh Hay que anular al disidente se plantearon cuestiones ante la comisión de ética judicial para que nos dijeran a los jueces que no podíamos salir a manifestarnos pero sin embargo efectivamente como decía Jorge tenemos libertad de expresión Pero además es que estamos obligados a defender el estado de derecho y la independencia judicial Y eso es lo que estaban haciendo pero como nada ocurre por casualidad yo yo recuerdo en un encuentro en el en el colegio de abogados de Madrid donde estaba María Jesús Moro en representación del partido popular que hubo una mesa redonda donde estaban todos los representantes de los grupos parlamentarios en la comisión de justicia y estaba el grupo sumar Enrique Santiago creo que se llama lo que primero contó lo que le pareció lo peor de lo peor aparte de la actitud del colegio de abogados que cómo se le ocurre personarse en estas cosas fue que los jueces nos plantá en la puerta de los juzgados defendiendo el estado de derecho todo obedece a un plan aquí nadie da puntada sin hilo hemos tenido demasiadas ramas demasiados árboles que no nos han permitido ver el Bosque pero tenemos que ver Que aquí hay algo y hay algo muy gordo y mire yo a veces siento no ser Polonia y lo digo en el sentido de que esto provocara la intervención de Europa España sigue siendo un país fuerte que Europa en en Europa importa importa además por determinados intereses económicos y eso es me temo lo que hace que no se produzca una intervención en la defensa de nuestro estado de derecho y de nuestra democracia y les decía que esta proposición de ley eh se entra como una proposición de Ley Orgánica antes decías Jorge que que hay que dar prioridad a a los proyectos de ley bueno eh yo recuerdo que el día que se presentó la proposición de ley pachi López dijo que a ver si no iba a poder hacer el el legislativo lo que quisiera y presentar las proposiciones a mí me explicaron en mi casa de pequeña que había cosas que se podían hacer pero que no convenía hacerlas y cuando tú presentas una proposición de ley en una materia trascendental como es regular el ejercicio de la acusación popular como es anular o o suprimir un delito del Código Penal y como es cercenar la libertad de expresión de los jueces tienes que presentar un proyecto de ley porque con una proposición de ley consigues el efecto pretendido lógicamente no tengo los informes preceptivos del Consejo general del poder judicial ni de el consejo fiscal ni del Consejo de estado por tanto tengo manga eng ancha puedo hacer o creo que puedo hacer lo que quiera eh pero es que además cercena a medida que va Vamos leyendo su articulado la propia acusación popular la deja sin efecto al final el acusador popular va a poner dinero a pagar la fiesta entre comillas y juzgado no es ninguna fiesta pero se puede personar deja la del dinero de la fianza pero allí es un convidado de piedra no se entera de nada de lo que ha pasado en el procedimiento y cuando acaba el jues dice mira o archivo o pea y el pobre dice yo para qué he venido aquí y no vamos a negar nadie y los que están ustedes aquí son conscientes de ello que se ha hecho una un uso abusivo de la acusación popular Mire yo recuerdo cuando al principio empezábamos a ver a los ayuntamientos y comunidades autónomas ejerciendo la acusación popular que yo decía Con todo el respeto pero que pintan aquí si no son ciudadanos que yo ya sé que hay estatutos de autonomía que reconocen esa facultad pero hasta donde yo sé la Constitución sigue diciendo que las leyes procesales son competencia exclusiva del Estado no de los estatutos de autonomía lo que pasa es que cuando las cosas no se recurren pues ahí quedan y luego nos encontramos con esto y claro que hay que restringir la pero restringir es una cosa suprimir y anular otra no existe ninguna necesidad Ahora ni urgencia por regular eh la acusación popular todos sabemos Cuál es la urgencia la disposición transitoria única nos dice dónde está la urgencia en la tramitación pero miren es que el día 3 de enero se publicó la Ley Orgánica 1/202 de eficiencia de Med eficiencia en servicio público de Justicia donde se reforma también la ley de enjuiciamiento criminal hombre pudieran ustedes haber aprovechado esa oportunidad en este anteproyecto que se aprobó el 21 de enero se reforma se podría llevar también esta reforma pero es que además sabemos que ahora se está tramitando o que se va a presentar no tardando el anteproyecto para dar la instrucción al ministerio fiscal por tanto lleven ustedes esta regulación de la acusación Popular a es ese momento porque una de las cosas que dice la exposición de motivos es que eh Bueno en realidad no supone tal limitación Y que no es preciso ese control digamos de la labor del fiscal lo estoy resumiendo eh Y diciéndo en fácil porque esto lo dice como más alargado pero hay que leer un poquito entre líneas y saber quién tienes de frente y viene a decir bueno como total el fiscal tiene unas amplias facultades de instrucción pues no pasa nada porque aunque ya el juez perdón el juez tiene facultades pues ya se encargará al juez de investigar hasta el final y cuando dentro de un año nos encontremos con la reforma de enjuiciamiento criminal y con que sea el fiscal el que instruye alguien tiene alguna duda de cuáles son los asuntos que se van a instruir en este país y los que no se van a instruir y alguien tiene alguna duda de que en qué procedimientos va a existir una acusación popular y En cuáles no porque esto no me no va a preocupar al que nos quita la cartera en Solo cuando nos pegamos un golpe con uno que ha bebido no Esto va a tener consecuencias en la vida política y me refiero porque se puede utilizar como un instrumento ento político y todos lo sabemos se dice que es necesario reformarlo eh la acusación popular para evitar filtraciones de verdad de verdad creemos que solo la acusación popular filtra nunca filtra el fiscal por ejemplo se me ocurre eh por poner un ejemplo la acusación particular o cualquiera de Incluso el propio acusado en muchas ocasiones eh se filtra como un instrumento como un arma de presión para sacar en los medios eso Es evidente que yo no digo que haya Que filtrar porque creo que las filtraciones deben perseguirse pero que esta no sea la excusa no pensemos que solo la acusación popular eh es la que filtra porque no nos hemos caído de ningún guindo se dice que es necesario regular y restringir la acusación popular porque hay que proteger también el derecho al honor y los derechos fundamentales mire cuando se publica una noticia que es falsa pues tenemos el derecho de rectificación y cuando se atenta contra nuestro honor tenemos la querella por injuria y C alumnas por tanto mecanismos legales hay la finalidad de este texto como ustedes ya lo saben y Son toos muy inteligentes por eso están aquí legislando pues como la conocen todos Yo no se la tengo que decir y por lo mismo esta proposición de ley no tendría que salir no se pueden hacer leyes a medida de nadie ni para beneficiar ni para perjudicar las leyes no pueden tener nombres y apellidos porque entonces no buscan el interés general y aquí debe buscarse el interés general de toda la sociedad de todos y cada uno de los ciudadanos que la integramos si no no somos una democracia somos otra cosa muy fea y yo me niego a ir en chándal por la calle me parece que tenemos una pregunta por aquí que cetana quería preguntar Sí yo quería hacer haceros una pregunta y creo que mi compañero Enrique belda también y no sé quién más yo Es que no puedo evitarlo teniendo teniendo expertos aquí delante no O sea Yo oigo debatir con toda buena fe sobre posibles reformas y mejoras no de la figura de la acusación popular y del proceso penal y pero vuelvo a a la pregunta que hacía Ignacio al final de su intervención No yo no encuentro tanto el para qué pero sí veo muy bien el para quién no es decir aquí la buena fe brilla por su asencia es decir claramente Esta es una proposición de ley orientada a un objetivo concreto eh que es la impunidad de determinadas personas y la confesión pública es la la disposición transitoria que en fin tiene todas las huellas dactilares puestas no tan todos los nombres y apellidos igual que la ley amnistía tenía nombres y apellidos esta ley tiene nombres y apellidos no pero hay una segunda parte muy evidente creo en la proposición que todavía no habéis tratado y es por quiero preguntaros por eso no Qué es este tufo de criminalización de los jueces y de la justicia eh Es decir esa idea de que enjuician llevados por sesgos políticos y en base a recortes de prensa no esos dos puntos que tiene la proposición de ley dando a entender que muchos jueces aquí están juzgando en base a recortes de prensa y y por sus ejos políticos y esto claro enmarca esta iniciativa en un proceso muchísimo más complicado más amplio y mucho más peligroso que hemos venido a llamar aquí de mutación de democracia plena fallida de Ataque a los contrapesos y de deslegitimación incluso de criminalización de la justicia no es decir la idea de que se levanta un muro contra la derecha se intenta se estrellan contra el derecho y entonces la solución es meter al derecho y la derecha del otro lado del muro no Esa es un poco la operación levanto muro a la derecha me estrello contra el derecho porque no funciona Entonces todos son del otro lado o fascistas con toga ultras etcétera jaurías ultras no y eso me parece hondamente preocupante me parece lo que está detrás de esta ley y que va mucho más allá de esta ley que engloba muchos otros elementos Aquí María Jesús experta en tema de Justicia quien lo lleva en fin todas las otras iniciativas sobre en fin el cambio en la procedimientos de selección de jueces etcétera etcétera me gustaría una reflexión vuestra que conocéis muy bien ese mundo sobre este particular abro vamos a ver una reflexión muy interesante que abres tú y es esta pl en el artículo 269 en el ordinal número 3 nos está diciendo que se in admitan aquellas denuncias que bueno pues estén basadas en hechos noticias periodísticas no y hace una serie de reflexiones que segismundo hacía digamos que mención a ellas yo lo que quiero decir es primero que todos los jueces tienen capacidad suficiente y necesaria además para distinguir entre los que son hechos los que son indicios verdad Y también lo que son opiniones o lo que son bulos y además Es que yo voy yo les voy a decir otra cosa para mí es una incoherencia dentro de esta pl verdad atribuirle una pericia al juez para decidir sobre la legitimación de una acusación popular y en cambio decir que no es apto para iniciar un determinado proceso esto es una reflexión que yo dejo Ahí abriendo Bueno pues el melón que acaba de abrir cetana y después simplemente dos cuestiones el 308 de la ley de enjuiciamiento criminal es claro al respecto vale eh Claro que se pueden iniciar y además tenemos la obligación de denunciar los hechos que pueden ser constitutivos de delito y el 303 nos dice que cualquier causa se puede iniciar de oficio por parte de un magistrado También queremos limitar eso A dónde vamos a parar limitemos ya todo absolutamente hemos vaciado de contenido un derecho constitucional como decía antes de larga tradición histórica jurídica en nuestra ordenamiento entonces entiendo que Esto va por donde exactamente dices tú Ni más ni menos y yo entiendo que cualquier noticia criminis puede ser investigada y que el juez tiene capacidad suficiente Si la tiene para unas cosas Por qué queremos que no la tenga para otras yo bueno la Es evidente y es cierto lo que acaba de decir pero pero no es algo nuevo es decir ya en Benjamín constante en el principios del 19 decía que el poder siempre activo siempre inquieto está siempre buscando Cómo derribar los diques que lo contiene invadir Las parcelas que que no le corresponden no Entonces esto es lo que hace el poder por por naturaleza y y por eso pues yo creo que es necesario que existan asociaciones y organizaciones que estén vigilando también el poder aparte de los propios contrapoder que que se establecen ya como como Estructura No lo que pasa es si es verdad que dentro de esa lucha permanente yo creo que estamos en una fase especial ahora mismo en España en relación con el poder judicial es decir la la la los desde la introducción en el famoso acuerdo con con juns de la palabra lofer como si asumiera la existencia de persecución judicial por motivos políticos y las actuaciones posteriores de desprestigio eh de los jueces de determinados jueces pero en general con una intención de generalización es algo extraordinariamente preocupante y además es algo no es particular de España pero si es particular los países que están en una mayor degradación del Estado de derecho es decir lo mismo se produjo en Polonia en un determinado momento y y las personas con las que tenemos contactos de otras organizaciones nos dicen no no es que el tema del desprestigio es fundamental es decir previamente hacer las reformas legislativas que de alguna manera desactivan ese control judicial se se produce esas campañas de desprestigio personal y de ataques no y efectivamente cuando nosotros nos estudiamos estábamos estudiando esta ley Pues sale la nueva propuesta sobre la modificación del sistema a la Justicia con lo cual ya prácticamente te impide mantener el foco en las circunstancias o sea yo creo que eso es es indudable Es así ha sucedido en otros lados y le tenemos que dar la importancia que tiene que es muchísima Sí yo simplemente estando Totalmente de acuerdo con con lo que has dicho es que a m ya el simple título de una gravedad absoluta porque claro dice proposición de Ley Orgánica de garantía y protección de los derechos fundamentales frente al acoso derivado de acciones judiciales abusivas o sea parte de la existencia de que hay acciones judiciales abusivas ya estamos con el choque o sea pasamos de la separación de poderes al choque entre poderes no y a la necesidad de que
